CONDITIONS OF USE

This System, including the data contained therein, is the property of the state of Illinois (“State”) and the Illinois Department of Children and Family Services (“IDCFS”), referred to jointly and interchangeably herein as either “IDCFS” or “the State.” By accessing and using this System, user agrees to the following terms and conditions:

LIMITED LICENSE

IDCFS grants user of the System a limited, non-exclusive, non-transferable, non-sublicensable license to access and make non-commercial use of the system for lawful purposes, but said license is restricted to use of only the areas of the System in which the user is authorized to access. This license does not include any resale, commercial use, or derivative use of the System or its contents. The use of data mining, scraping, harvesting, robots, spiders, crawlers, and/or similar data gathering or extraction tools is strictly prohibited. User may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with the System and its data, whether in whole or in part. The use of any process, software, mechanism, tool, device or other means to send automated queries to the System is strictly prohibited.

SHARING OF LOGIN CREDENTIALS PROHIBITED

User is strictly prohibited from sharing user’s login credentials for the System with any other person or entity. User shall not allow any individual or entity to view any data in the System or to access any area in the System that has been accessed through user’s login credentials, unless authorized to do so by IDCFS. User accepts full legal and financial responsibility for any unauthorized use of the System or data breach that occurs as a direct or indirect result of user’s intentional or negligent failure to prevent user’s login credentials from being utilized by any person or entity other than the user.

UNAUTHORIZED ATTEMPT OR USE

Unauthorized attempts to access the employee-only or any other restricted area of the system are strictly prohibited. Unauthorized attempts to upload information or change information on this system are strictly prohibited and may be punishable under the Computer Fraud and Abuse Act of 1986.

RESERVATION OF RIGHTS

The State reserves the right to deny access to any users it deems to be in violation of these Conditions of Use and will pursue all legal remedies for any such violations. All rights not expressly granted to user in these Conditions of Use are reserved and retained by the State. User may use the system only as permitted by law and in accord with these Conditions of Use. The license granted by the State herein terminates if user does not comply with these Conditions of Use.

PRIVACY NOTICE

Please review the State’s Privacy Notice https://www.illinois.gov/about/privacy.html, which also governs user’s access and use of this System, to understand the State’s practices. The legal notices set forth in the State’s Privacy Notice, including, but not limited to, the disclaimer of liability and disclaimer of warranties/accuracy of data, are incorporated herein.

CHOICE OF LAW

Construction of disclaimers contained in the State’s privacy policy and resolutions of disputes arising from use of this system and its data are governed by the laws of the state of Illinois. By use of this system and any data contained therein, the user agrees that their use shall conform to all applicable laws and regulations and user shall not violate the rights of any third parties.

PUBLIC RECORDS

Information contained within the system is considered public record and is thus subject to disclosure by the State; however, some, but not all, of the information may fall within an exemption to the Illinois Freedom of Information Act. By accessing this system, user acknowledges that their information may be disclosed to a third-party in response to a request for information, a court order, or other lawful process.

LOGO

The logo of any governmental entity is important because it represents to the public that a document or action is authoritative and official. Unlawful use of the IDCFS or State logo is strictly prohibited.

DISPUTES

Any dispute or claim relating to user’s use of this system will be adjudicated in a court of competent jurisdiction in the state of Illinois. By the use of this system, user consents to exclusive jurisdiction and venue in the state of Illinois.

APPLICABLE LAW

By accessing this system, user agrees that applicable federal law, and the laws of the state of Illinois, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between user and the State relating to this system.

SYSTEM POLICIES, MODIFICATION, AND SEVERABILITY

IDCFS reserves the right to make changes to this System, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
